GameConnect Terms of Service

These Terms of Service ("Terms") govern your access to and use of GameConnect (the "Platform"), operated by Midwest Athletics Academy & Events ("Company," "we," "our," or "us"). By accessing or using the Platform, you agree to be bound by these Terms. If you are using the Platform on behalf of a school or organization, you represent that you have authority to bind that entity to these Terms.

1. Description of Service

GameConnect is a subscription-based software platform designed to assist athletic directors and athletic programs in scheduling games, tournaments, scrimmages, and related athletic events. The Platform facilitates connections but does not guarantee outcomes or event fulfillment.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of your organization to use the Platform.

3. Account Registration and Security

You agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your information.
  • Keep login credentials secure.

You are responsible for all activity under your account. We are not liable for unauthorized access resulting from your failure to secure your credentials.

4. Subscription, Billing, and Cancellation

4.1 Subscription Model

GameConnect is offered on an annual subscription basis.

4.2 Auto-Renewal

SUBSCRIPTIONS AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS CANCELED PRIOR TO RENEWAL.

By subscribing, you authorize us to charge your payment method on a recurring basis.

We will provide advance notice (via email or in-platform notification) prior to renewal.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing cycle. You will retain access until that time.

4.4 Renewal

You may cancel your subscription at any time. Cancellation will stop future billing and your access will continue through the end of the current paid term.

4.5 Fees and Refunds

  • All fees are stated in U.S. dollars.
  • Payments are non-refundable unless otherwise required by law.
  • No prorated refunds will be provided for partial billing periods.

4.6 Price Changes

We reserve the right to modify pricing with at least 30 days' notice. Changes will apply to future subscription terms and will not affect your current active subscription period.

5. Acceptable Use

You agree not to:

  • Use the Platform for unlawful or fraudulent purposes.
  • Submit false, misleading, or inaccurate scheduling data.
  • Impersonate another organization or individual.
  • Interfere with or disrupt the Platform.
  • Attempt to reverse engineer, duplicate, or resell the Platform.

We reserve the right to suspend or terminate accounts violating this section.

6. User Content

You retain ownership of all data you submit ("User Content"). You grant the Company a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display User Content solely to:

  • Operate and provide the Platform.
  • Improve services and functionality.
  • Generate aggregated and anonymized analytics.

You are solely responsible for the accuracy and legality of your User Content.

7. Intellectual Property

The Platform, including the GameConnect name, branding, trademarks, business content, and customer-facing materials, is owned by or licensed to Midwest Athletics Academy & Events.

Certain software, source code, design systems, technical components, and other proprietary technology used to build, maintain, or operate the Platform may be owned by third-party licensors or developers and are used by Midwest Athletics Academy & Events under license or other lawful authority.

Except as expressly permitted in writing, you may not:

  • Copy, modify, or distribute the Platform.
  • Create derivative works of the Platform.
  • Use the Platform for competitive or benchmarking purposes.

All rights not expressly granted are reserved.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We expressly disclaim any guarantees regarding:

  • Successful scheduling or match fulfillment.
  • Availability or responsiveness of other users.
  • Accuracy or reliability of user-generated data.
  • Platform uptime or uninterrupted access.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDWEST ATHLETICS ACADEMY & EVENTS SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • LOSS OF DATA, REVENUE, OR OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Midwest Athletics Academy & Events from any claims, damages, or expenses arising out of:

  • Your use of the Platform.
  • Your User Content.
  • Your violation of these Terms.

11. Termination

We may suspend or terminate your account at our discretion, including for violations of these Terms. Upon termination, your right to use the Platform will immediately cease.

12. Dispute Resolution and Arbitration

All disputes shall be resolved through binding arbitration on an individual basis. You waive the right to participate in class actions or jury trials.

13. Governing Law

These Terms shall be governed by the laws of the State of Michigan, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
